We examine the notion of cognitive artifact and its possible application to the animal technic. Although the issue of animal technic is not very much discussed, the case studies focused on the capacity of using and manufacturing tools suggest that some animals deploy cognitive skills. Could the tools employed by animals be considered genuine cases of cognitive artifacts? In this paper we propose a definition of “cognitive artifact” based on the notion of “proper function,” which allows us to develop a (...) gradual scale where we place different kinds of artifacts according to the prevalence of the cognitive function (in opposition to the prac-tical one). Applying this scale to the non-human sphere, we defend the idea that there exists a range of non-human technical phenomena of use and artifacts and tools manufacturing, and that some of this artifacts have an incipient proper cognitive function. In order to defend these theses, we examine the examples of the cobwebs, the nests and the honeycombs. (shrink)

In this chapter we use methods of corpus linguistics to investigate the ways in which mathematicians describe their work as explanatory in their research papers. We analyse use of the words explain/explanation (and various related words and expressions) in a large corpus of texts containing research papers in mathematics and in physical sciences, comparing this with their use in corpora of general, day-to-day English. We find that although mathematicians do use this family of words, such use is considerably less prevalent (...) in mathematics papers than in physics papers or in general English. Furthermore, we find that the proportion with which mathematicians use expressions related to ‘explaining why’ and ‘explaining how’ is significantly different to the equivalent proportion in physics and in general English. This article synthesizes the results of several interviews with argumentation scholars from across the American continents to address three questions regarding the connections in argumentation studies between North and South/Central America: “What motivated the study of argumentation in the Americas?” “What commonalities, if any, exist in argumentation studies across the Americas?” and “What should the future of argumentation studies in the Americas look like?” Using these interviews in combination with existing textual sources, the article also provides motivated suggestions for directions (...) for the future of the community in the field. Why I thought it useful to offer an explanation of Hegel’s doctrine on the Incarnation was so that the reader may be empowered to identify Hegel’s influence in modern accounts of this mystery. Even if, in my view, Hegel’s interpretation of revealed religion differs greatly from Catholic Doctrine, it is not surprising to find the presence of some of his concepts in modern theology. In truth, what matters is not the theologian’s self-identification as Hegelian or as non-Hegelian, but whether or (...) not the theologian adopts Hegel’s concepts. This paper offers an explanation of the internal dynamism of Hegelian concepts and their relation to Christian doctrine in Hegel’s Phenomenology of Spirit. This research may help to show in what way it is possible to explain Christian religious doctrine with a philosophy other than the Thomistic one and how, at least in Hegel’s case, religious doctrine is changed and reduced to an erroneous philosophical content. Also, an attempt is made to show the internal “coherence” of this Hegelian re-reading of Christianity so that theologians may become more cautious about accepting an explanation of Christian doctrine simply because the Christian language is preserved in that explanation. Our purpose is to defend the possibility of “perceptualism,” that is to say, the position maintaining that the intelligible content of consciousness is given in perception and not posited by the activity of the subject. Assisted by the insights of Cornelio Fabro, this defense contrasts perceptualism with Bernard Lonergan’s “critical realism”. Current work in language models (LMs) helps us speed up or even skip thinking by accelerating and automating cognitive work. But can LMs help us with critical thinking -- thinking in deeper, more reflective ways which challenge assumptions, clarify ideas, and engineer new concepts? We treat philosophy as a case study in critical thinking, and interview 21 professional philosophers about how they engage in critical thinking and on their experiences with LMs. We find that philosophers do not find LMs to (...) be useful because they lack a sense of selfhood (memory, beliefs, consistency) and initiative (curiosity, proactivity). We propose the selfhood-initiative model for critical thinking tools to characterize this gap. Using the model, we formulate three roles LMs could play as critical thinking tools: the Interlocutor, the Monitor, and the Respondent. We hope that our work inspires LM researchers to further develop LMs as critical thinking tools and philosophers and other 'critical thinkers' to imagine intellectually substantive uses of LMs. (shrink)

This paper introduces a body of research on Organizational Behavior and Industrial/organizational Psychology that expands the range of empirical evidence relevant to the ongoing character-situation debate. This body of research, mostly neglected by moral philosophers, provides important insights to move the debate forward. First, the OB/io scholarship provides empirical evidence to show that social environments like organizations have significant power to shape the character traits of their members. This scholarship also describes some of the mechanisms through which this process of (...) reshaping character takes place. Second, the character-situation debate has narrowly focused on situational influences that affect behavior episodically and haphazardly. The OB/io research, however, highlights the importance of distinguishing such situational influences from influences that, like organizational influences, shape our character traits because they are continuous and coordinated. Third, the OB/io literature suggests that most individuals display character traits that, while local to the organization, can be consistent across situations. This puts pressure on the accounts of character proposed by traditional virtue ethics and situationism and provides empirical support to interactionist models based on cognitive-affective processing system theories of personality. Finally, the OB/io literature raises important challenges to the possibility of achieving virtue, provides valuable and untapped resources to cultivate character, and suggests new avenues of normative and empirical research. Scholars who favor shareholder primacy usually claim either that managers should not fulfill corporate duties of beneficence or that, if they are required to fulfill them, they do so by going against their obligations to shareholders. Distinguishing between structurally different types of duties of beneficence and recognizing the full force of the normative demands imposed on managers reveal that this view needs to be qualified. Although it is correct to think that managers, when acting on behalf of shareholders, are not (...) required to fulfill wide duties of charity, they are nevertheless required to fulfill a variety of narrow duties of beneficence. What is more, the obligation to fulfill these duties arises precisely because they are acting on behalf of shareholders. As such, this article 1) refines our understanding of the duties of corporate beneficence and 2) helps to identify which duties of beneficence are imposed on managers when they are acting on behalf of shareholders. In this paper I argue that the search for explainable models and interpretable decisions in AI must be reformulated in terms of the broader project of offering a pragmatic and naturalistic account of understanding in AI. Intuitively, the purpose of providing an explanation of a model or a decision is to make it understandable to its stakeholders. But without a previous grasp of what it means to say that an agent understands a model or a decision, the explanatory strategies will (...) lack a well-defined goal. Aside from providing a clearer objective for XAI, focusing on understanding also allows us to relax the factivity condition on explanation, which is impossible to fulfill in many machine learning models, and to focus instead on the pragmatic conditions that determine the best fit between a model and the methods and devices deployed to understand it. After an examination of the different types of understanding discussed in the philosophical and psychological literature, I conclude that interpretative or approximation models not only provide the best way to achieve the objectual understanding of a machine learning model, but are also a necessary condition to achieve post hoc interpretability. This conclusion is partly based on the shortcomings of the purely functionalist approach to post hoc interpretability that seems to be predominant in most recent literature. (shrink)

(From the Introduction) The topic I would like to present is “Scholasticism and Thomism” as found in Chapter 7 of Fabro’s "Brief Introduction to Thomism". My presentation, as both a summary and a partial commentary on some aspects of this work, may be helpful as we wait for the English translation of Fabro’s book. The title of this chapter says exactly what Fr. Fabro wants to do. He wants to relate Scholasticism and Aquinas in two senses: 1) from a historical (...) point of view, so that we may understand the origins, context and later fortune of the doctrine of St. Thomas, and 2) from a doctrinal point of view (and this is the most important) so that we may clearly distinguish St. Thomas’ doctrine from the rest of Scholasticism. This is very important because some people have tried to understand the Church’s invitation—or, rather, instruction—to study St. Thomas as simply a broad invitation to study Scholastic philosophy and theology. This is clearly not the case. The Church wants us to study the principles of Thomistic doctrine which, many times, are substantially different from other scholastic doctrines. (shrink)

Kant and Aquinas: who can doubt they are different? And however, there are some who equate Aquinas and Kant in doctrines in which they are actually opposed; some attribute to St. Thomas Aquinas approaches that are Kantian and by no means Thomistic. They make those mistakes by misinterpreting or misusing Aquinas’ texts. This paper intends to clarify a little bit the radical difference between the approaches of Aquinas and Kant to human knowledge. In my view, we need first of all (...) to understand the problem of the universals, which is the basic problem of human understanding and, in a sense, the only problem of philosophy. Second, we need to understand the stance of both philosophers in front of this same problem. Only then will we be able to see what and how radical is the difference between Aquinas and Kant. ABSTRACT:The distinction between what I call nonelective obligations and discretionary obligations, a distinction that focuses on one particular thread of the distinction between perfect and imperfect duties, helps us to identify the obligations that carry over from principals to agents. Clarity on this issue is necessary to identify the moral obligations within “shareholder primacy”, which conceives of managers as agents of shareholders. My main claim is that the principal-agent relation requires agents to fulfill nonelective obligations, but it does not always (...) require discharging discretionary obligations. I show that the requirement to fulfill nonelective obligations is more far-reaching than has been acknowledged by most defenders and critics of shareholder primacy. But I also show that managers are not bound by certain discretionary obligations like charity, showing that their moral obligations are more circumscribed than the obligations that apply to human beings in general. Here the point of departure of Being and Time is criticized, i.e. the priority of Dasein in the determination of the meaning of being. An overview of Heidegger’s doctrine is offered, his concern for intentionality is acknowledged, then it takes place a critique of his starting point, and finally a Thomistic alternative account of intentionality is proposed.

St. Thomas Aquinas has always considered intelligence a potency higher than the will, absolutely speaking. That being said, and in my view, the existential primacy of the will in the act of freedom (particularly in choosing the existential end) is also indisputably Thomistic, as Cornelio Fabro has shown. This paper endeavors to explain Aquinas' doctrine on the absolute primacy of the intellect and thus show that these two primacies can be affirmed coherently, that is, the intellect’s absolute primacy and the (...) will’s existential primacy. Firstly, I will explain the reasoning St. Thomas Aquinas uses in the Summa to justify the absolute primacy of the intellect over the will. Secondly, I will explore some parallel texts, in order to shed light on my interpretation of the Summa and expand our view regarding this and related doctrinal points. Thirdly, I will offer a brief study of Fabro’s position, one in which his concerns regarding the intellect’s absolute primacy are taken into account and carefully considered. (shrink)

This paper is an attempt to clarify, from a Thomistic point of view, the nature and method of metaphysics. I argue that metaphysics' object is created being, not God, even if God enters metaphysics as efficient cause of metaphysic's object. Also, that metaphysics is a science, insofar as a particular kind of coherent reasoning process, going from the many to understand a certain oneness, and then from that oneness to reinterpret the many. Moreover, that, in this particular process of reasoning, (...) doctrinal topics must follow a certain order. Thus, in particular, I argue that the distinction between essence and act of being in every creature cannot be argued before arguing the existence of God. I touch upon the notion of separation in metaphysics and I compare Aquinas' notion of resolution with Fabro's notion. (shrink)

This study draws on deontic justice theory to examine an unexplored socioemotional micro-foundation of corporate social responsibility (CSR), namely anticipated guilt, in an effort to improve our understanding of employees’ moral reactions to their organization’s CSR. We empirically investigate whether environmental CSR induces anticipated guilt (i.e., concerns about future guilt for not contributing to organizational CSR) leading to organizational environmental citizenship behavior. We also consider two boundary conditions related to the social nature of anticipated guilt: line manager support for the (...) environment and negative environmental group norms. To test our hypotheses, we analyzed data from a convenience sample of 503 managers working in Mexican organizations, using Latent Moderated Structural equation modeling. Overall, our results support the deontic argument that employees care about CSR because CSR embodies moral concerns. Specifically, our findings show that efforts to avoid a guilty conscience increase when the line manager provides increased resources and control to act for the environment, and when group members do not care for the environment, suggesting that employees feel they have to compensate for their group’s moral failure. Duties of beneficence are said to allow for leeway to discharge them. By distinguishing between two different types of leeway, Mejia identified three structurally different duties of beneficence. In this Commentary I deploy those distinctions to clarify the nature of a fourth type of duty of beneficence, one prompted by a global pandemic, a duty with a peculiar, and seldom recognized, conceptual logic. I provide some guidelines that should orient managers when they take themselves to be fulfilling such a duty (...) on behalf of shareholders. (shrink)

What is the distinction between understanding and forming a concept? In my view, for Aquinas, intelligere (the act of understanding) and dicere (the forming of a verbum or mental word) are not two different acts, but simply two different aspects of the same act of understanding. In the following, I will explore more in depth what this distinction means for Aquinas. Firstly, I will give a mostly doctrinal or systematic overview of the issue and, secondly, I will support my claims (...) with relevant textual evidence, taken exclusively from Aquinas’ Summa Theologiae. This study, as an appendix, is part of “The Influence of Kant in Transcendental Thomism: Rahner, Lonergan and Von Balthasar” (forthcoming). In my view, Lonergan’s way of distinguishing intelligere and dicere is different from St. Thomas’ way. In the body of my book, I focus on Lonergan’s reasons to distinguish these notions in his own particular way, whereas this study focuses on St. Thomas’ doctrine. It is my hope that the following lines will foster an understanding of St. Thomas’ epistemology and of its application to Trinitarian theology. (shrink)

Many word forms in natural language are polysemous, but only some of them allow for co-predication, that is, they allow for simultaneous predications selecting for two different meanings or senses of a nominal in a sentence. In this paper, we try to explain (i) why some groups of senses allow co-predication and others do not, and (ii) how we interpret co-predicative sentences. The paper focuses on those groups of senses that allow co-predication in an especially robust and stable way. We (...) argue, using these cases, but focusing particularly on the multiply polysemous word ‘school’, that the senses involved in co-predication form especially robust activation packages, which allow hearers and readers to access all the different senses in interpretation. The purpose of this paper is to give the main lines of a theological accounting for the fullness of knowledge in Christ from the time of his conception. We follow the doctrine of St. Thomas and take into account some objections which are relatively modern. The paper is intended as a systematic articulation that is faithful to the Tradition and the doctrine of the Church and also concerned with faithfully interpreting the whole biblical narrative in our preaching. In particular, we (...) have in mind Gilles Mongeau’s question: “If from the beginning [Jesus] has all knowledge, how could he learn, which is such a fundamental part of a genuinely human existence?” We try to connect the issue of the knowledge of Christ with the reasons for the Incarnation. First, we show that our theological accounting finds support in the Magisterium and in the Bible. Secondly, we try to articulate systematically the reasons for affirming the fullness of human knowledge in Christ and the progression in his acquired knowledge. (shrink)

The fact that names refer to individuals is a basic assumption of referentialist theories of proper names, but the notion of individual is systematically taken for granted in those theories. The present paper follows that basic assumption, but proposes to analyze the notion of individual prior to the development of any semantic theory of proper names. It will be argued that a particular perdurantist conception of individual should be adopted, which distinguishes the notions of individual occurrence, and individual simpliciter. A (...) new theory of proper names (called the cluster-occurrence theory) is presented, according to which names refer to individual occurrences, and the intension associated with a name is an individual simpliciter. The merits of the new theory are then assessed in confrontation with its standard rival accounts. (shrink)

The following is an interpretation of Aquinas’ agent intellect focusing on Summa Theologiae I, qq. 75-89, and proposing that the agent intellect is a metaphysical rather than a formal a priori of human understanding. A formal a priori is responsible for the intelligibility as content of the object of human understanding and is related to Kant’s epistemological views; whereas a metaphysical a priori is responsible for intelligibility as mode of being of this same object. We can find in Aquinas’ text (...) many indications that the agent intellect is not productive of the universal as content but is, rather, productive of the abstracted or intelligible mode of being of the universal nature. This is because for Aquinas the universal nature, which is the object of human understanding, is present in the things themselves but with a different mode of being. Chapter 1 is intended to establish the fact which requires for Aquinas an agent intellect, and provides two very important principles: one is that the object of human understanding (the universal nature) is present in the things themselves and, the other, that it is not in the things themselves with a mode of being which makes it available to the intellectual eye. These two principles lead us to the main point of Chapter 2, namely the distinction between the intelligible object and its intelligible mode of being. Now, because knowing is receptive of the intelligible object (Chapter 3), which is present in the things themselves (Chapter 1), the agent intellect is productive not of the object’s intelligible content, but of its abstracted or intelligible mode of being (Chapter 4). There is a growing awareness that there are many subtle forms of exclusion and partiality that affect the correct workings of a judicial system. The concept of epistemic injustice, introduced by the philosopher Miranda Fricker, is a useful conceptual tool to understand forms of judicial partiality that often go undetected. In this paper, we present Fricker’s original theory and some of the applications of the concept of epistemic injustice in legal processes. In particular, we want to show that the seed (...) planted by Fricker has flourished into a rich field of study in which the concept is used to analyze many different phenomena in law, not always following the original characterization provided by her. This has led to a distinction between what we will call the narrow version of the concept, which is closer to Fricker’s original account, and the wider version of epistemic injustice, which is a more controversial notion because it is always on the verge of morphing into other well-known concepts like sexism, racial discrimination, oppression, silencing, and gaslighting. We will show that the value of the narrow version is mostly theoretical, and that in order to use the concept of epistemic injustice one must adopt a more liberal understanding of it. (shrink)

In the first section I set out what I take that distinction, as Carnap draws it, to be, and spell out a central motivation Carnap has for invoking it. In the second section I endorse, and augment, Yablo's response to Quine's arguments against Carnap. In the third section I say why Carnap's application of the distinction between internal and external questions runs into trouble. In the fourth section I spell out what I take to be Yablo's version of Carnap. In the last I say why that version is especially vulnerable to the objection raised in the second. (shrink)

>e paper studies the discussion about human good in Eudemian Ethics I.7. It is particularly concerned with the existence, in the text, of two characteristics of the human good: its peculiarity, on the one hand, which consists not only in the quali- (cation ‘human’ (anthropinon), but also in the assignment of this good to the domain of action (the activity that distinguishes humans from other beings), and, on the other hand, the fact that it belongs to a spectrum containing the (...) goods of other beings, like god and the remaining living beings. Divinity works as the standard for the distinction between eudaimonic goods – belonging to beings whose nature implies participation in the divine (humans, for example) – and non-eudaimonic goods that belong to those beings deprived of such participation. Resorting to other passages from the Eudemian Ethics, as well as other texts from the corpus, the paper defends that the two characteristics of the human good presented in EE I.7 foreshadow an important di?erence between the two Aristotelian treatises on eudaimonia: whereas the Nicomachean Ethics emphasizes contemplation as the activity through which humans participate in the divine, the Eudemian Ethics stresses virtuous actions as a human activity related to the divine. Vision is an important metaphor in ethical and political questions of knowledge. The feminist philosopher Donna Haraway points out the “perverse” nature of an intrusive, alienating, all-seeing vision (to which we might cry out “stop looking at me!”), but also encourages us to embrace the embodied nature of sight and its promises for genuinely situated knowledge. Current technologies of machine vision – surveillance cameras, drones (for war or recreation), iPhone cameras – are usually construed as instances of the former rather (...) than the latter, and for good reasons. However, although in no way attempting to diminish the real suffering these technologies have brought about in the world, I make the case for understanding technologies of computer vision as material instances of embodied seeing and situated knowing. Furthermore, borrowing from Iris Murdoch’s concept of moral vision, I suggest that these technologies direct our labor towards self-reflection in ethically significant ways. My approach draws upon paradigms in computer vision research, phenomenology, and feminist epistemology. Ultimately, this essay is an argument for directing more philosophical attention from merely criticizing technologies of vision as ethically deficient towards embracing them as complex, methodologically and epistemologically important objects. : New genetic technologies continue to emerge that allow us to control the genetic endowment of future children. Increasingly the claim is made that it is morally "irresponsible" for parents to fail to use such technologies when they know their possible children are at risk for a serious genetic disorder. We believe such charges are often unwarranted. Our goal in this article is to offer a careful conceptual analysis of the language of irresponsibility in an effort to encourage more care (...) in its use. Two of our more important sub-claims are: A fair judgment of genetic irresponsibility necessarily requires a thick background description of the specific reproductive choice; and there is no necessary connection between an act's being morally wrong and its being irresponsible. Unlike other classical arguments for the existence of God, Pascal’s Wager provides a pragmatic rationale for theistic belief. Its most popular version says that it is rationally mandatory to choose a way of life that seeks to cultivate belief in God because this is the option of maximum expected utility. Despite its initial attractiveness, this long-standing argument has been subject to various criticisms by many philosophers. What is less discussed, however, is the rationality of this choice in situations where the (...) decision-makers are confronted with greater uncertainty. In this paper, I examine the imprecise version of Pascal’s Wager: those scenarios where an agent’s credence that God exists is imprecise or vague rather than precise. After introducing some technical background on imprecise probabilities, I apply five different principles for decision-making to two cases of state uncertainty. In the final part of the paper, I argue that it is not rationally permitted to include zero as the lower probability of God’s existence. Although the conditions for what makes an act uniquely optimal vary significantly across those principles, I also show how the option of wagering for God can defeat any mixed strategy under two distinct interpretations of salvation. In a recent paper, Erasmus et al. (2021) defend the idea that the ambiguity of the term “explanation” in explainable AI (XAI) can be solved by adopting any of four different extant accounts of explanation in the philosophy of science: the Deductive Nomological, Inductive Statistical, Causal Mechanical, and New Mechanist models. In this chapter, I show that the authors’ claim that these accounts can be applied to deep neural networks as they would to any natural phenomenon is mistaken. I also (...) provide a more general argument as to why the notion of explainability as it is currently used in the XAI literature bears little resemblance to the traditional concept of scientific explanation. It would be more fruitful to use the label “understandable AI” to avoid the confusion that surrounds the goal and purposes of XAI. In the second half of the chapter, I argue for a pragmatic conception of understanding that is better suited to play the central role attributed to explanation in XAI. Following De Regt (2017) and Kuorikoski and Ylikoski (2015), the conditions of satisfaction for understanding an ML system are fleshed out in terms of an agent’s success in using the system. Para comprender se requiere reconocer lo otro en su carácter de tú, asumir que no se tiene distancia frente a él y estar abierto a acoger lo dicho por él como una posible verdad. La compresión posee una estructura dialéctica que implica la cancelación de las propias expectativas y el acceso a un saber más abarcante. Cornelio Fabro -/- Por lo tanto, nos (...) proponemos investigar su propuesta de solución. El p. Fabro defendía la necesidad de la dependencia causal a través de la noción de participación. Nuestro objetivo es por tanto hacer un análisis crítico de la postura del p. Fabro acerca de la dependencia causal como exigencia del ser participado, a través del estudio de algunas de sus obras más importantes al respecto. Buscamos respondernos por qué para el p. Fabro el ser participado exige una causa, y valorar sus argumentos. -/- Como hemos dicho, para nuestro trabajo nos valdremos ante todo del estudio de algunas de las obras más importantes del p. Cornelio Fabro con respecto a la causalidad. Nos referimos en concreto a tres de ellas: la primera, el artículo La difesa critica del principio di causa, donde el autor expone de un modo preciso la noción de participación como el fundamento de la justificación crítica del principio de causalidad. Las otras dos obras son La Nozione Metafisica di Partecipazione secondo San Tommaso d’Aquino, donde la noción de participación es puesta al centro de la metafísica tomista, como clave de bóveda de las tesis más características de la doctrina del Angélico; y Partecipazione e Causalità, obra en la cual el autor rescata el esse tomista original como fundamento de una metafísica de la causalidad. -/- Este estudio nos ha llevado a destacar la importancia de la noción de “ser que no es por sí” como noción esencialmente relacionada a la noción de participación y por otro lado cuasi necesaria para hacer el pasaje a la causa. This research intends to show a Kantian influence in Transcendental Thomism, particularly in Rahner, Lonergan and Von Balthasar. What is meant by a Kantian influence is a certain attitude regarding the problem of the universals, an attitude which is radically different from St. Thomas’. In my previous work (The Radical Difference between Aquinas and Kant: Human Understanding and the Agent Intellect in Aquinas [Chillum: IVE Press, 2021], the radical difference between St. Thomas and Kant was shown. In this present research, (...) what is argued is that Rahner, Lonergan and Von Balthasar follow Kant, not St. Thomas, with regard to the analysis of human understanding. From each Transcendental Thomist author mentioned above, I have taken one sample text, one most significant work where each author’s epistemology can be explored. Did we get Aquinas’ Epistemology right? St. Thomas is often interpreted according to Kantian principles, particularly in Transcendental Thomism. When this happens, it can appear as though Aquinas, too—along with Kant—had made the “turn to the subject”; as if Aquinas were no longer the Aristotelian “believer” who thinks nature is what it is but, instead, the Kantian “thinker” who holds that nature is what we think of it; as if St. Thomas, like Kant, had concluded that nature is intelligible not (...) only when we think of it, but because we think of it. After much struggle with this problem, the challenge seemed obvious to me: to show the radical difference between Aquinas and Kant. Kant had reasons to make his turn, his Copernican revolution. Could I explain those reasons, could I pinpoint the problem leading Kant to think in those terms? Could I show Aquinas facing the same problem and clearly taking a different direction in his proposed solution? That is what I have tried to do in this book. This book provides an interpretation of Aquinas’ agent intellect focusing on Summa Theologiae I, qq. 75-89, and proposing that the agent intellect is a metaphysical rather than a formal a priori of human understanding. A formal a priori is responsible for the intelligibility as content of the object of human understanding and is related to Kant’s epistemological views, whereas a metaphysical a priori is responsible for intelligibility as mode of being of this same object. We can find in Aquinas’ text many indications that the agent intellect is not productive of the intelligible object but is, rather, productive of the abstracted or intelligible mode of being of this object. This is because for Aquinas the universal as nature, which is the object of human understanding, is present in the things themselves but with a different mode of being. In this four-chapter book, Chapter 1 is intended to establish the fact which requires for Aquinas an agent intellect, and provides two very important principles: one is that the object of human understanding (the universal as nature) is present in the things themselves and, the other, that it is not in the things themselves with a mode of being which makes it available to the intellectual eye. These two principles lead us to the main point of Chapter 2, namely the distinction between the intelligible object and its intelligible mode of being. Now, because knowing is receptive of the intelligible object (Chapter 3), which is present in the things themselves (Chapter 1), the agent intellect is productive not of the object’s intelligible content, but of its abstracted or intelligible mode of being (Chapter 4). Por medio de un contraste con el pensamiento heideggeriano, el estudio desarrolla la concepción gadameriana de la alteridad, el lugar que ocupa este tema en la propuesta hermenéutica de Verdad y Método y la reformulación que ello supone de la manera como Heidegger concibe la aperturidad de la existencia humana y el acontecimiento mismo del ser. El trabajo inicia planteando la crítica de Gadamer al reconocimiento ontológico del otro por parte de Heidegger; muestra enseguida la oposición que se presenta entre (...) el “ser-para-la-muerte” y el “ser-para-la-historia”, la relevancia que tiene en Gadamer la vida práctica y la idea de diálogo como modelo de la comprensión. Se concluye mostrando la oposición que se da entre ambos autores en la manera de considerar el modo de ser del lenguaje y el acontecimiento del ser que en éste tiene lugar. [/] -/- In permanent contrast with Heidegger’s thought, this study develops Gadamer’s conception of otherness, its place in the hermeneutic project of Truth and Method and the reformulation that all this entails of human existence disclosedness and the event of being itself. Work starts raising Gadamer’s critique to the ontological [42] recognition of the others by Heidegger; it shows then the opposition between the “being-towards-death” and “being-for-history”, and the relevance of practical life and the idea of dialogue as a model of understanding in Gadamer’s philosophy. It is a widespread opinion that toleration, as a political practice, has merely instrumental value. The aim of this paper is to defend, on the contrary, that toleration has political value in itself. In more specific terms, I will claim that it is valuable in itself in virtue of its intrinsic relationship with democracy. Toleration is a constituent of democracy inasmuch as it is necessary for the existence of a democratic administration of political power. I will show that that relation (...) of constitution holds because toleration, through the protection of spaces of contestation to the political power, contributes to solving democracy’s inner tension resulting from its practical implementation. -/- Es una opinión extendida que la tolerancia, en cuanto práctica política, tiene valor meramente instrumental. El objetivo de este artículo es defender, por el contrario, que ella tiene valor político en sí. Específicamente, defenderé que es valiosa en sí misma a causa de su relación intrínseca con la democracia. La tolerancia es un constituyente de la democracia en cuanto es necesaria para que pueda existir una administración democrática del poder político. Mostraré que esa relación de constitución existe porque la tolerancia, mediante la protección de espacios de contestación al poder político, contribuye a la resolución de una tensión interna de la democracia en su implementación práctica. Los sesgos cognitivos afectan negativamente la toma de decisiones en todas las esferas de la vida, incluyendo las decisiones de los jueces. La imposibilidad de eliminarlos por completo de la práctica del derecho, o incluso de controlar sus efectos, contrasta con el anhelo de que las decisiones judiciales sean el resultado exclusivo de un razonamiento lógico-jurídico correcto. Frente el efecto sistemático, recalcitrante y porfiado de los sesgos cognitivos, una posible estrategia para disminuir su efecto es enfocarse, no en modificar el (...) comportamiento de los agentes judiciales, sino en moldear su entorno para que los sesgos tengan menos oportunidades de aparecer. En particular, es más provechoso concentrar los esfuerzos en identificar aquellas reglas procesales que faciliten o limiten el efecto de los sesgos. En este ensayo propongo un diálogo fructífero entre el derecho y la psicología que puede llevar a mejorar la calidad de los sistemas judiciales. La propuesta está basada en la creación de guías de práctica judicial que puedan servir de base para la creación de protocolos procesales que limiten en la medida de lo razonable sus efectos negativos y conduzcan a mejores decisiones judiciales. Bioethicists appearing in the media have been accused of "shooting from the hip" (Rachels, 1991). The criticism is sometimes justified. We identify some reasons our interactions with the press can have bad results and suggest remedies. In particular we describe a target (fostering better public dialogue), obstacles to hitting the target (such as intrinsic and accidental defects in our knowledge) and suggest some practical ways to surmont those obstacles (including seeking out ways to write or speak at length, rather than (...) in sound bites). We make use of our own research into the way journalists quote bioethicists. We end by suggesting that the profession as a whole look into this question more fully. (shrink)

Cada día es más evidente que existen muchas formas sutiles de exclusión y parcialidad que afectan el correcto funcionamiento de los sistemas jurídicos. El concepto de injusticia epistémica, introducido por la filósofa Miranda Fricker, ofrece una herramienta conceptual útil para comprender estas formas de exclusión y parcialidad judicial que a menudo pasan desapercibidas. En este artículo presentamos la teoría original de Fricker y algunas de las aplicaciones del concepto de injusticia epistémica en los procesos jurídicos. En particular, queremos demostrar que (...) la semilla sembrada por Fricker ha generado un floreciente campo de estudio en el cual el concepto se utiliza para analizar muchos fenómenos diferentes en el ámbito jurídico, no siempre siguiendo la caracterización original proporcionada por ella. Esto ha llevado a una distinción entre lo que llamaremos la versión estrecha del concepto, que se acerca a la descripción original de Fricker, y la versión más amplia de injusticia epistémica, que es una noción más controvertida porque existe el riesgo de que se confunda con otros conceptos más conocidos como el sexismo, la discriminación racial, la opresión, el silenciamiento y el gaslighting. Mostraremos que el valor de la versión estrecha es principalmente teórico y que para utilizar el concepto de injusticia epistémica se debe adoptar una comprensión más liberal del mismo. (shrink)

The author asks whether there was a “scientific ‘68”, and focuses on aspects of two specific methodological proposals defined in the 1940s and 50s by the terms “action research” and “mixing methods”, applied particularly to social sciences. In the first, the climate surrounding the events of 1968 contributed to heightening the participative element to be found –by definition– in “action research”; that is: the importance of making the research subjects themselves participants in the design, execution and application of the study (...) of which they are the focus. This approach captured the democratic and anti-authoritarian spirit at the heart of the proposal, which was part of the prevailing climate in those days. The repercussions of 1968 on “mixing methods” focused on studying what had actually occurred, especially between the youth and workers, and therefore, particularly from the point of view of sociology and social psychology, using a “mixed methods” approach. The author explores the proposal of Norman Denzin; but traces the recent origins of both “mixing methods” and “action research” back to the proposals of mainly Kurt Lewin and the Chicago School.
